US Department of Labor Provides Guidance on Independent Contractor Classification

The U.S. Department of Labor’s Wage and Hour Division has issued a field assistance bulletin to guide the determination of employee or independent contractor status under the Fair Labor Standards Act. While reviewing the 2024 final rule, which is also being challenged in federal court, investigators are directed not to apply the 2024 rule’s analysis in current enforcement matters. Instead, they will rely on longstanding principles outlined in Fact Sheet #13 and Opinion Letter FLSA2019-6. This approach aims to provide clarity for businesses and workers in modern work arrangements while legal questions are resolved. The guidance does not change existing regulations but reflects how enforcement resources are allocated during the review.
