In a significant move, Microsoft has replaced Simpson Thacher & Bartlett with Jenner & Block as its legal representative in a case concerning the acquisition of Activision Blizzard. This decision comes shortly after Simpson Thacher agreed to a deal with the Trump administration to perform $125 million worth of pro bono legal work for causes aligned with the administration’s preferences.
According to court filings on April 22, Simpson Thacher withdrew from representing Microsoft in the case. On the same day, partners from Jenner & Block informed the court that they would take over the representation. Jenner & Block is currently engaged in litigation against the Trump administration, seeking to permanently block an executive order targeting its business.
This shift from Simpson Thacher, which has aligned itself with the Trump administration through its pro bono commitment, to Jenner & Block, which actively opposes the administration in court, sends a strong signal. While Microsoft has declined to comment on the decision, it is widely interpreted as a preference for firms that are willing to challenge authoritarian actions rather than collaborate with them.
The move highlights the potential consequences for law firms that align themselves with controversial political administrations, as clients may prioritize firms that align with their values and are willing to stand up to government pressure. — new from Above the Law
