Burger King Faces Lawsuit Over Whopper Size Discrepancy

Burger King is facing a lawsuit alleging that its advertisements misrepresent the size of its Whopper sandwich and other menu items. A US District Judge in Miami ruled that it is plausible some consumers could be misled by the company’s ads. The plaintiffs, consisting of 19 customers from 13 states, claim that nearly all menu items are exaggerated in size in Burger King’s advertisements. For instance, the Whopper is portrayed as 35% larger than the actual product and with more than double the meat content. Burger King defends itself by stating that their advertising aims to make the food appear as appetizing as possible. However, Judge Roy Altman found the allegations go beyond mere exaggeration. This case differs from similar lawsuits dismissed against McDonald’s and Wendy’s due to the degree of alleged misrepresentation in Burger King’s ads. Burger King maintains that the claims are false and that the beef patties shown in their ads are the same used in their burgers served across the U.S.
